The Ministry of Railways has notified the Railway Services (Extraordinary Pension) Rules, 2026, establishing comprehensive provisions for disability pension and family pension in cases where death or disability of railway employees is attributable to railway service. According to reports from The Times of India and Mint, the rules classify cases into four categories based on the circumstances of death or disability, with specific pension rates and eligibility criteria for each category. The new framework replaces the 1993 rules and provides for family pension, disability pension and constant attendant allowance in specified cases, with benefits linked to the option exercised under the Railway Services (Implementation of National Pension System) Rules, 2025 for NPS-covered employees. The Railway Services (Implementation of the Unified Pension Scheme under the National Pension System) Rules, 2026 were notified on September 16, 2026 and published in the Gazette of India on September 21, 2026, coming into force on the date of publication.
For qualifying cases under Categories B, C and D, disability pension comprises a service element equal to 50% of emoluments or average emoluments, whichever is more beneficial. As reported by The Times of India and Mint, the disability element varies by category: Category B and C offer 30% of emoluments/average emoluments for 100% disability, while Category D provides 100% of emoluments/average emoluments. The rules establish a minimum disability pension of ₹18,000 per month and allow for broad-banding of disability assessment, with disability above 75% and up to 100% reckoned as 100%. An eligible pensioner with 100% disability may additionally receive a constant attendant allowance if a medical board determines that the person is completely dependent on another person for day-to-day activities and requires a constant attendant.
Family pension rates vary significantly by category, with Category B offering 60% of pay, Category C providing 100% of pay, and Category D maintaining 100% of pay. According to Mint, the benefit is not limited to a spouse and extends to eligible children in specified circumstances when there is no qualifying spouse, with provisions for children with specified disabilities. The minimum family pension is fixed at ₹18,000 per month, with detailed eligibility conditions applying separately to different categories of family members based on age, marital status, and income requirements. The rules provide for family pension to eligible children in specified circumstances when there is no qualifying spouse, ensuring comprehensive coverage for dependent family members.
For NPS-covered railway employees, the option recorded under the 2025 NPS rules is crucial for determining family pension entitlements. As reported by Mint, the 2026 extraordinary pension rules specifically state that if an NPS-covered railway employee dies or is discharged from service because of disability, family pension, disability pension and constant attendant allowance will be payable if the employee had exercised the relevant option under Rule 10. The rules mandate processing through railway's online systems within two months for disability pension cases and one month for Pension Payment Order issuance. Special provisions exist where disability pensioners who die within seven years of boarding out due to the same injury or disease can have their families eligible for family pension under the same category.
The Railway Board has implemented the Unified Pension Scheme (UPS) for railway employees under the National Pension System, bringing assured-pension benefits to the country's largest employer. According to the latest notification, railway servants appointed on or after January 1, 2004 who want to opt for UPS as an NPS option are covered, while those in casual, daily rated employment, contract workers, and those who have opted out of UPS are excluded. Railway servants in service as on April 1, 2025 have until three months from April 1, 2025 to apply in Form A2, while those joining on or after April 1, 2025 get 30 days from the date of joining to enroll directly. The scheme operates on a defined contribution basis with 10% subscriber contribution and 10% government contribution of emoluments, with a one-time switch facility available to revert to NPS within 12 months before superannuation or 3 months before voluntary retirement.
