The International Financial Services Centres Authority (Ifsca) is planning to establish an independent arbitration centre in GIFT City to enhance dispute resolution capabilities and improve ease of doing business in India's flagship global financial services hub. According to a government official, this represents the biggest reform that Ifsca is working on and is identified as a key requirement for GIFT City's success as an international financial centre. The proposal is currently under government consideration, with an expert committee already constituted to examine the matter. As per the latest reports, the government is actively pursuing the creation of the arbitration centre, demonstrating strong commitment to this transformative initiative.
Businesses operating from GIFT City currently must approach commercial courts for dispute resolution, creating operational inefficiencies. The lack of an independent arbitration centre has been identified as a key demand of reinsurers located in GIFT City, as reported by the government official. The creation of an independent dispute resolution mechanism within GIFT City is expected to significantly improve the ease of doing business for financial services companies operating in the hub, addressing a critical gap in the current regulatory framework.
Narendra Kumar Bharindwal, president of the Insurance Brokers Association of India (IBAI), highlighted that GIFT City has no independent arbitration centre compared to Dubai International Financial Centre (DIFC) and Singapore. He noted that such an institution will be crucial for GIFT City's success as an international financial hub and represents an attempt to position GIFT City as a competitive rival to major global financial hubs such as Dubai and Hong Kong. The Gujarat International Finance Tec-City houses India's only International Financial Services Centre, which was established to attract global financial services and bring offshore financial activities to India.
According to existing data cited by the official, Ifsca estimates that more than 50 global reinsurers could establish a presence in GIFT City over the next two years. The establishment of an independent arbitration centre is positioned as a strategic move to strengthen GIFT City's position as a leading international financial services hub and enhance investor confidence in the regulatory framework. This projection underscores the significant potential for growth in India's flagship financial services hub once the arbitration centre becomes operational.
